Comment:
In this case, first appellate authority has directed the appellant to deposit 25% of demand created, aggrieved against the orders of 1st Appellate authority, appellant filed appeal before Tribunal who observed that in time barred case there is no requirement to deposit 25% of demand and quashed the assessment order.
